Justification:
There were instances involving alien petitioners whose petition for adoption filed under the Domestic Adoption Act of 1998 was granted by the court, yet the adopted child was not allowed to enter the alien’s country. Thus, in order to avoid this situation, courts must require the alien petitioner to submit the clarification that his or her government allows the adopted child to enter the alien’s country, which is not waived under the quoted Section 7 (b).

Dear family,
The purpose of this letter is to set out the NSW Department of Family and Community Services’ (FACS) position about the adoption of a relative or known child who is not an Australian citizen and who is habitually resident in an overseas country.
FACS currently has responsibility for providing intercountry adoption services. These services are provided by FACS’ Adoption Services. The Director of this service holds the position of the NSW Central Authority for the Hague Convention on the Protection of Children and Co-operation in respect of Intercountry Adoption (the Convention) of which Australia is a member. This year marks the ICAB’s 20th Anniversary. In June 7, 1995, Republic Act 8043 otherwise known as the Philippine Inter-country Adoption Act of 1995 was passed into law. The law created the Inter-country Adoption Board as the Central Authority in matters relating to the inter-country adoption of Filipino children and as the policy making body for purposes of carrying-out the convention requirement (Article II Section 4 of RA 8043).
On April 21, 2015, President Aquino appointed new members of the Inter-Country Adoption Board for a term of six years: Antonia C. Siy (psychologist), Rosario B. dela Rosa (registered social worker), Maria Gabriela R. Concepcion (lawyer), Eric Remegio O. Panga (lawyer), Ma. Teresa R. Nuqui (NGO) and Maria Carolina T. Legarda (NGO).
The new Board members took their oath of office on May 4, 2015 before Secretary Corazon Juliano Soliman, Secretary of the Department of Social Welfare and Development (DSWD), Ex Officio Chair of the Inter-Country Adoption Board.

The Intercountry Adoption Board is coordinating the collection of stuffed toys for distribution to the children in Tacloban City and other affected areas.
